TERMS AND CONDITIONS

  • It is important that you read and understand these terms and conditions before you action the following with us via our website - Enquire about buying a Watch, either from the Axia Watch Collection or with Axia Consult; Or Enquire about selling or servicing a Watch with us. 

  • By ordering and purchasing any of our Watches, or by selling or servicing any of your Watches with us, you agree to be bound by these terms and conditions. 

  • If there is anything that you do not understand or do not accept, then please discuss this with us before making an order and purchase.

  • This section tells you information about us and the legal terms and conditions that will apply to any contract between us for the sale of our Watches to you.

  • You should print a copy of these terms and conditions for future reference.

 

DEFINITIONS

  • When the following words are used in these Terms, they will have the following meanings:

  • Watch: Watch(es) that we are selling to you as set out in the Order.

  • Axia Watch Co, our, we, us: Axia Watch Co Ltd (registered in England and Wales with company number 11811613).

  • Website: the website at the domain www.axiawatchco.com

  • Unless the context otherwise requires, words in the singular shall include the plural and in the plural shall include the singular. 

 

OUR CONTRACT WITH YOU 

  • You will not be able to place an order and transact with us until you have firstly enquired. We can then let you know the availability of the desired Watch. 

  • When you use the Enquire facility, this means you will have registered your interest in one of our Watches. We can accordingly provide additional information on the Watch. If you are interested in purchasing the Watch, subject to availability, a purchase price is agreed between you and Axia Watch Co. Delivery price is also stated and is agreed on top of this. This Order Summary, which will hence include the agreed purchase price for the Watch in addition to the agreed delivery price, will be sent to you from us via email. You will agree the payment method with us, as outlined in ‘Price and Payment’ clause below. 

  • Once payment has been received by Axia Watch Co Limited in full and funds have been cleared, we will send an order confirmation receipt and the contract between us will be formed. The Watch will then be dispatched to you by courier. 

  • All Watches shown on our Website are subject to availability. We may be unable to supply you with the Watch if it is no longer in stock or has been reserved by another customer. We will let you know if this applies to you. 

  • The Watches displayed for sale on our Website may not be available for dispatch until Work has been completed while it is undergoing a service at the time you enquire. We will let you know if this applies to you. 

  • We usually cannot give an estimated date for completion of the Work, but we shall provide an estimated completion date.

  • You can cancel your Order at any time before dispatch of the Watch.

  • The images of the Watches on our Website are taken first hand by us, and are for illustrative purposes only. We have made every effort to display the colours accurately. However, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the Watches. Your Watch may vary slightly from those images.

  • You are declaring that you are 18 years of age or over by placing an Order for the Watches. Our Watches are age restricted. 

  • The packaging of the Watches may vary from that shown on images on the Website. We cannot guarantee that boxes and/or other packaging supplied are authentic.

 

PRICE AND PAYMENT 

  • Following your Enquiry to us, a final price is verbally agreed with you should you wish to proceed and purchase, subject to availability. This will be noted in writing in our Order Summary email to you. If you agree to transact, you will be required to pay the total sum as outlined in this Order Summary email. 

  • The prices of our Watches may change at any time, but any price changes will not affect Orders that have been confirmed with you, as set out in the Order Summary email. 

  • The price of the Watches quoted on our website excludes delivery costs. You will be informed of delivery costs following your initial enquiry to us. If you then agree to place an order and purchase a Watch, the final delivery costs will be displayed in the total amount due in the Order Summary email.  

  • All Watches will remain available for sale until you have paid the balance in full. This is applicable irrespective of any third party finance application made by you. 

  • You must make payment for the Watch in advance and we must receive full and cleared funds prior to dispatch of the Watch. If we do not receive payment, we will notify you. 

  • Please see our payment methods below. 

  • We can accept the following payment methods if you are based in the UK: 

  • Bank Transfer: We will provide you with our bank details and what transfers we can accept upon agreement to transact;

  • Card Payments: 3D secure card payments, including Mastercard and Visa; 

  • Cheque: Payable to ‘Axia Watch Co Limited’. Allow up to 9 Working Days for funds to clear into our account;

  • Bankers draft: Payable to ‘Axia Watch Co Limited’. All drafts will be authenticated by our bank before the Watch(es) are dispatched. 

  • You must pay by an international bank transfer if you are based outside of the UK.

  • Following your Enquiry and decision to proceed and purchase, we will email you an Order Summary that includes a breakdown of the agreed price of the Watch, agreed delivery charges and a total amount payable. 

  • We will produce an order confirmation receipt that shall be emailed to you upon receipt of cleared funds. 

  • You may opt to purchase any of our Watches that may be advertised to sell on Chrono 24. You will accordingly be transacting using one of the payment methods offered by Chrono 24. Their privacy policy will take the place of our privacy policy if you do chose to do this. 

  • All currency values in the Terms and Conditions are in GBP and are therefore subject to the current exchange rate at the time of transaction. This does not affect your Consumer Rights. 

  • The prices quoted on our website are in Pounds Sterling. Payments must be made to us in Pounds Sterling. We do not accept liability for fluctuations in the exchange rate. 

 

DELIVERY 

  • Delivery charges will be discussed with you following your initial ‘Enquiry’ to us and prior to agreeing a final total price upon your decision to purchase the Watch from us. Delivery charges will be borne by you. This will then be shown in the Order Summary email that we verbally agree and email to you. We will therefore advise you of our delivery charges before your Order is confirmed.

  • Deliveries within the UK are made using the Royal Mail service. Deliveries outside the UK are made using DHL. 

  • Delivery dates will vary depending on the availability of the Watches and your address. We will provide you with an estimated delivery date. All dates quoted by us for dispatch and delivery of the Watches are estimates only.

  • We do not accept responsibility and will not be liable for late deliveries due to circumstances outside of our control or your failure to provide us with adequate delivery instructions. Occasionally our delivery to you may be affected by an Event Outside Our Control. 

  • We cannot deliver the Watches to the certain countries. You will be notified if this is the case once your delivery address is established upon your initial contact with us. 

  • Normally a signature is needed for receipt of the Watch by an adult (aged 18 years or over) at the delivery address (whether yourself or a member of your household). If no-one is available when the carrier attempts delivery, the carrier may leave a calling card for you to re-arrange delivery at a more convenient time. You may need to collect the Watch from your local delivery office provided you can produce adequate proof of identity. 

  • Any parcel that has been damaged or tampered with should not be signed for and delivery should be refused.

  • We will deliver the Watch to the delivery address given in your Order. We will send the Watch once we have received payment in full. If you pay by debit or credit card, the Watch must be dispatched to the billing address of the card holder.

  • A Watch may be collected by appointment at a location elected by us, but we have the right to refuse and send by courier as outlined above. We will not be liable for losses you incur including travel costs if you travel without making an appointment in advance.

  • Delivery of the Watch will be completed when we deliver the Watch to the address given in your Order or when the Watch is collected by appointment.

  • If you arrange for another courier to collect the Watch, delivery will be completed when the Watch is collected from us. This means that we will not be responsible if the Watch is lost or damaged in the course of transit.

  • The Watch will be your responsibility from the completion of delivery.

 

CUSTOMS

  • If you are based outside the UK, you may also have to pay import duty or other taxes, fees or charges applied by customs or other authorities in the country of receipt. You must comply with all laws and regulations of the country in which you are receiving the Watch(es). Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. If you are unsure about whether these charges might apply to your Order, you should contact your local tax or customs office for further information.

 

THE WATCH YOU PURCHASE

  • You acknowledge that water resistant Watches are not water proof. You must be careful with wearing your Watch in or around water; Wearing your Watch near hot water, diving into water or the movement of your arms whilst swimming can compromise the water resistance of your Watch; Leaving a screw-in crown open or operating your Watch whilst in or around water can cause severe damage to your Watch because your Watch will not be water resistant. Damage caused in any of these ways to your Watch, or as a consequence of any direct water damage, will not be covered by our warranty. You acknowledge and accept that we will not replace seals and/or gaskets or other parts. 

  • Our Watch specifications state what wrist size that particular Watch bracelet will fit around, as our bracelet sizes do vary. A bracelet size will be requested from you before your order is dispatched to aim to ensure that the bracelet on that particular Watch will fit you pre-purchase. 

  • Additional links will only be supplied where possible, as the Watch bracelets are not always supplied to us with a full accompaniment of links, and at our discretion.

  • If the Watch is sold with Paperwork, the age of the Watch is calculated from the date given on the Paperwork, which is when the Paperwork was officially stamped. You acknowledge that the date of manufacture may be earlier than the Paperwork date.

  • If the Watch is sold without Paperwork, it can be difficult for us to calculate the age of the Watch. You acknowledge that the age of the Watches listed on the Website may therefore be an estimate only. This would be calculated by reference to the serial number, owner information or other indicators.

 

RETURNS AND REFUNDS PRIOR TO DISPATCH 

  • You may cancel your Order for the Watch, before we dispatch the Watch to you, without giving any reason. 

  • To exercise the right to cancel, you must inform us prior to dispatch. Please e-mail at contact@axiawatchco.com.

  • The cancellation right does not apply to Watches that have been adjusted to meet your specifications or personalised prior to dispatch .

  • If you cancel your Order following payment to us, but prior to us dispatching the Watch to you, we will reimburse you in full for the Watch. This reimbursement excludes the cost of delivery that you may have paid prior.

 

RETURNS AND REFUNDS FOLLOWING DISPATCH 

  • The cancellation period within which you can request a return, will expire after 14 days from the day the Watch has been delivered to you or your nominated recipient. To exercise the right to cancel, you must inform us within these 14 days. Please e-mail at contact@axiawatchco.com.

  • You shall send the Watch back without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the Watch before the period of 14 days has expired. If more than 14 days has passed since the day on which you communicate your cancellation from this contract to us, and you have not sent the Watch, we cannot offer you a refund.

  • Watches purchased by you will have been transacted by one of our agreed payment methods and delivered to you via courier. These Watches will come with a tamper-proof returns sticker and tempered glass screen protector which allows for the Watch to be tried on and examined for any faults upon arrival. You must inspect the Watch upon delivery. Returns will not be accepted if the tamper-proof returns sticker and/ or tempered glass screen protector has been damaged or removed so please examine the Watch thoroughly to ensure you are completely satisfied with the product upon arrival before removing these. 

  • You must take reasonable care of the Watch and you must return the Watch (including Paperwork, links, user manual, service papers and box as applicable). The Watches must be in their original condition, unworn and undamaged. 

  • Return postage, packaging and insurance will be your responsibility and at your cost and you must follow our reasonable instructions. We recommend you use a tracked mail system and retain proof of postage. You must insure the Watches to their full value. You must ensure that you pack the Watches appropriately to prevent damage during transit.

  • To complete your return, we require a receipt or proof of purchase. Do not send your purchase back to the manufacturer. 

  • Once your return is received by Axia Watch Co, we will send you an email to notify you that we have received your returned Watches. 

  • Returned Watches will be inspected by our servicing team who will assess the returned Watch. You thereby acknowledge the following: 

  • You will incur a charge for any Work necessary if the returned Watches are found to be damaged or otherwise compromised from you handling the Watches beyond what is necessary to establish the nature, characteristics and functioning of the Watch. 

  • We may make a deduction from the reimbursement for loss in value of any Watch as the result of any unnecessary handling by you. 

  • You acknowledge that the Paperwork (where supplied) substantially increases the value of the Watches and that its absence or damage will affect the value of the Watch. If you return the Watch with missing or damaged Paperwork, we will make a reasonable deduction to the sum refunded to you not exceeding 25% of the purchase price.

  • Watches that have been adjusted to meet your specifications or personalised to you will not be eligible for a refund.

  • We reserve our right to refuse a return if the tamper-proof returns sticker and/or tempered glass screen protector has been removed or damaged. 

  • We reserve our right to refuse a return and refund if parts of the Watch that we originally sent to you, are missing or damaged.

  • Provided that the condition of the returned Watch to us is in original condition, unworn and undamaged, you will be refunded in full within 14 days of the date we receive the returned Watch. This refund excludes all delivery costs associated. 

  • We will make the reimbursement using the same means of payment as you used for the initial transaction. 

  • Any refunds will only be issued by us in Pounds Sterling. We do not accept liability for fluctuations in the exchange rate, which may affect any refund if you are based outside the UK. 

  • In the event that Watch is returned to you following a refused reimbursement sale, packaging and insurance will be your responsibility. Axia Watch Co relinquishes all responsibility for the safe delivery of Watch in this instance.

 

FAULTY ITEMS 

  • You must inspect the Watch as soon as reasonably practicable after delivery and you must inform us promptly if the Watch is faulty or not as described (‘Faulty’) upon delivery. Please e-mail at contact@axiawatchco.com.

  • Watches purchased will have been transacted by one of our agreed payment methods and delivered to you via courier. These Watches will come with a tamper-proof returns sticker and tempered glass screen protector which allows for the Watch to be tried on and examined for any faults upon arrival. You must inspect the Watch upon delivery. Faulty returns will not be accepted if the tamper-proof returns sticker and/ or tempered glass screen protector has been damaged or removed so please examine the Watch thoroughly to ensure you are completely satisfied with the product upon arrival before removing these. By removing the tamper-proof returns sticker and/or tempered glass screen protector, you comply that Watch was not faulty on delivery and that the relevant Watch was as described on delivery to you. 

  • Prior to couriering, each of our Watches will undergo a pre-delivery check with photos taken and dated. You are made aware of the Watch condition pre couriering. 

  • You must take reasonable care of the Watch and you must return any Watches that are Faulty (including Paperwork, links, user manual, service papers and box as applicable) promptly once advising us of the relevant Faulty Watch.

  • Provided you comply with these obligations, and upon confirmation by us following inspection and/or testing that the Watches were Faulty on delivery, and/or provided the relevant Watch was not as described upon delivery, you will be entitled to the following remedies:

  • you may ask us to replace the Watch, though you acknowledge that we may not be able to source a suitable replacement, and we are under no obligation to replace the Watch where this is impossible or imposes costs on us that are unreasonable, in which case your remedy will be limited to either a refund or repair subject to the terms set out in this clause;

  • you may ask us to repair the Watch, though we are under no obligation to repair the Watch where this is impossible or imposes costs on us that are unreasonable, in which case your remedy will be limited to either refund or replacement subject to the terms set out in this clause; or

  • you may ask us to refund your payment in full or in part within 14 days of the Watch being returned to us, but before a decision is made by us in regards to this potential refund of your payment, you acknowledge the following: 

  • The Paperwork (where supplied) substantially increases the value of the items and that its absence or damage will affect the value of the item. If you return the Watches with missing or damaged Paperwork, we will make a reasonable deduction to the sum refunded to you not exceeding 25% of the purchase price.

  • We reserve our rights to reduce any reimbursement if Paperwork is missing or damaged.

  • We may make a deduction from the reimbursement for loss in value of any Watch as the result of any unnecessary handling by you. 

  • We reserve our rights to refuse a return for a faulty item if the tamper-proof returns sticker and/or tempered glass screen protector has been removed or damaged.

  • We reserve our right to refuse a return and refund if parts of the Watch that we originally sent to you, are missing or damaged. 

  • Provided that the condition of the returned Watch to us is in original condition, unworn and undamaged - not including the specific fault outlined by you upon delivery - you will be refunded in full within 14 days of the date we receive the returned Watch.

  • Return postage, packaging and insurance will be your responsibility and you must follow our reasonable instructions. We recommend you use a tracked mail system and retain proof of postage. You must insure the Watches to their full value. You must ensure that you pack the Watches appropriately to prevent damage during transit.

  • If your Watch is Faulty on delivery and you are based within the UK, we will refund your reasonably incurred return postage costs to a maximum of £10, provided you comply with our reasonable return instructions and you provide us with a copy receipt.

  • If your Watch is Faulty on delivery and you are based outside the UK, we will refund your reasonably incurred return postage costs to a maximum of £10, provided you comply with our reasonable return instructions and you provide us with a copy receipt.

  • You acknowledge that a reasonable time for completion of a repair may extend to several months for Events Outside Our Control.

  • If you buy several Watches from us as part of the same Order, and only some of these Watches are Faulty, you may return the Faulty Watches in accordance with this clause, but this does not entitle you to return other Watches which are not Faulty.

 

OUR RIGHT TO CANCEL

  • We may have to cancel an Order before the Watches are delivered, for example, due to an Event Outside Our Control or the unavailability of stock. We will contact you as soon as possible if this happens.

  • If we have to cancel an Order and you have made any payment in advance for a Watch that has not yet been delivered to you, we will refund these amounts to you within 7 Working Days (unless we reasonably suspect a fraudulent card payment).

 

OUR LIABILITY

  • We shall under no circumstances whatever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any indirect or consequential loss arising under or in connection with a failure by us to comply with these Terms

 

EVENTS OUTSIDE OUR CONTROL

  • We will not be responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by Events Outside Our Control. This does not affect your legal rights.

  • An Event Outside Our Control means any act or event beyond our reasonable control including acts of local or central government or other competent authorities, interruption or failure of utility services, severe weather, disputes, accident, interruption or failure of our Website or IT system caused by third parties, or delays or non-performance caused by third parties including manufacturers, banking providers, the Royal Mail, or DHL, or another Courier that may be used.

 

OUR WARRANTY

  • Every Watch we sell comes with a 12-month Warranty on the movement of the Watch.

  • Our Warranty does not cover theft or loss of the watch, normal wear-and-tear or damage caused to the Watch by accidents, mishandling/mistreatment or negligence (including damage caused by failure to follow our instructions). Wear of the Watch strap, glass, clasp and cosmetic damage are not covered by our Warranty. If there is damage caused by deviations in time-keeping or water ingress, this is not covered by our Warranty. 

  • We do not guarantee that your Watch will keep typical expected tolerances for timekeeping, and it is no longer suitable for use in wet environments or submersion in water. 

  • Your Warranty will be invalidated in the event that a third party carries out any tests or work on your Watch without our prior knowledge and consent. 

  • Any modification of a Watch by the addition or substitution of components by aftermarket products will also invalidate the Warranty.

  • If you wish to make a claim against your Warranty, please email contact@axiawatchco.com. We will then notify you of next steps. 

  • Return postage, packaging and insurance will be your responsibility and you must follow our reasonable instructions. We recommend you use a tracked mail system and retain proof of postage. You must insure the Watch to their full value. You must ensure that you pack the Watch appropriately to prevent damage during transit.

  • If you are based within the UK, we will refund your reasonably incurred return postage costs to a maximum of £10, provided you comply with our reasonable return instructions.

  • If you are based outside the UK, we will refund your reasonably incurred return postage costs to a maximum of £10, provided you comply with our reasonable return instructions.

  • In all cases, you remain responsible for ensuring that you pack your Watch appropriately to prevent damage during transit. The Watch is your responsibility until it reaches us. 

  • If you purchased the Watch in the first instance from us, it must be you who makes the claim, otherwise the claim will be refused. Your Warranty is personal to you and is non-transferable.

  • If you are based outside of the UK, you may also have to pay import/export duty or other taxes, fees and charges applied by customs or other authorities for work carried out on your Watch, particularly if you do not correctly complete the relevant declarations. You must comply with all laws and regulations of your country. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. If you are unsure about whether these charges might apply to your order, you should contact your local tax or customs office for further information. Given our reliance at times on third parties, you acknowledge that a reasonable time for completion of a repair may extend to several months for Events Outside Our Control.

  • Once your Watch is received and inspected by us, we will send you an email to notify you that we have received your returned item. We will only be liable to repair the movement of the Watch once we have received the Watch upon delivery. You agree to have the movement of the Watch serviced by, and in conjunction with, our professional and experienced Watchmaker. 

  • We will not be liable for any other damages or faults that may have been incurred in the time between you owning the Watch following purchase and us receiving the Watch when you sent the Watch to us for repair. 

  • Once the works has been completed, we will let you know via email and arrange postage back to you. We are under no obligation to complete the works within a definitive or set timescale. This delivery will be in line with our ‘Delivery’ terms.

  • A tamper-proof returns sticker and tempered glass screen protector will be reapplied prior to us sending. This allows for the Watch to be tried on and examined for any faults upon arrival. You must inspect the Watch upon delivery and notify us promptly if the movement of the Watch is still faulty. Returns will not be accepted if the tamper-tamper-proof returns sticker and tempered glass screen protector has been damaged or removed so please examine the Watch thoroughly to ensure you are completely satisfied with the product before removing these. 

  • We have the final decision on all claims against our Warranty. We have the right to refuse a repair based on the terms set out in the ‘Returns and Refunds Following Dispatch’ clause as set out in our Terms and Conditions. It is important you read and understand these terms.  

  • The warranty is in addition to your statutory and common legal rights.

 

SELL 

  • If you would like to sell your Watch, you can sell your items either to us or through us. That is, you can sell your items to us in an outright sale. Alternatively, we can attempt to sell your items to a customer on your behalf, for which we take a commission of the final sale proceeds.

  • If you would like to sell your Watch through either of the above basis, you will need to provide us with details of your Watch, in the ‘Sell’ section of our website.

  • Please provide information about your items fully and accurately. Any quotation, whilst given in good faith, is derived from a combination of factors including without limitation the information supplied by you. The provision of inaccurate, false or misleading information by you may result in an inaccurate valuation which cannot be relied upon by you.

  • You will then receive either a phone call or an email with an initial valuation for a stock sale or detailing the process for a commission sale. 

  • Any valuations are provided on a "subject to contract" basis and are not legally binding. We reserve the right to amend or withdraw the valuation at any time without liability to you. If we suggest a sale price for a commission sale, you are under no obligation to follow our suggestion.

  • If you are happy with the initial valuation, and the process, then we will discuss and agree next steps before proceeding. This will include our full Terms and Conditions that includes our process for Delivery, Final Valuation, Your Final Decision, Price and Payment, Your Undertakings, Loss or Damage. These Terms and Conditions will be set out and sent to you individually in full for you to review. We can alternatively provide these as part of our initial phone call or email. 

 

SERVICING

  • Fill out the details in our ‘Servicing’ section with as much information as possible about the works you think are required. We will get in contact either by phone call or email to discuss next steps. We will request photos of the Watch be sent to us in the first instance. We will show these to our professional and experienced Watchmaker, who will attempt to assess and examine the condition, to acquire and provide you with an initial quote. 

  • If your photos are of poor quality, or information limited, this may hinder our ability to provide an accurate quotation for the works.

  • Any quotation that we give at this stage, before we have had an opportunity to carry out a full assessment of your Watch, though given in good faith, is an estimate only. We may need to alter our quotation once we have carried out a full inspection.

  • If you are happy with the initial valuation, then we will discuss and agree next steps before proceeding. This will include our full Terms and Conditions that includes our process for Delivery, Final Valuation, Your Final Decision, Price and Payment, Your Undertakings, Loss or Damage. These Terms and Conditions will be set out and sent to you individually in full for you to review. We can alternatively provide these as part of our initial phone call or email.

 

CONSULT

  • We take into account vintage and pre-owned Watches that we will endeavour to ultimately acquire. 

  • We will endeavour to provide suitable options to you in response to your submission form. These will include options that we can work to and look to acquire. There is no guarantee that we will ultimately acquire the Watch. 

  • There is no definitive or set timeline as to when we will ultimately acquire the Watch should we be able to be able to do so in time. 

  • We will aim to either call or email you with our initial response to your submission form. There is no definitive or set timeline as to when this response from us will be. We are under no obligation to respond to every submission. 

  • We do not source specific Watches at your request, and are under no obligation to source specific Watches at your request, as part of the service. This service not does not source rare Watches that have waiting lists with the manufacturer. 

  • Each submission will be judged and treated on a case by case basis. How we deal with each case is down to our own discretion. It the Watch is ultimately acquired and purchased from us, it is treated akin to purchasing from our Watch Collection in that you shall receive a one year Warranty on the movement of the Watch. We ensure all Watch are genuine and authentic prior to any acquisition by us in the first instance. All Watches are inspected by our Watchmaker. 

  • If the value of the Watch you are keen to acquire surpasses a certain value, as you will have quoted in the ‘budget’ section, we may contact one of our trusted and reputable partners to see if they have the Watch in their stock. This certain value is judged at our discretion. We ensure all of these Watches are genuine and authentic. Should they have the Watch in stock, we may inform you of this option. Should you opt to purchase by this means, we charge an upfront introduction fee. This fee fluctuates on a case by case basis, depending on the value of the Watch in that particular case. Should you make a purchase by this means, at this stage, our Terms and Conditions and Privacy Policy are superseded by theirs, and you agree to their Terms and Conditions and Privacy Policy. 

  • We do not guarantee that every option will be ideally suited to your criteria. We will ask questions to qualify your criteria to gain a better understanding of your requirements. The information that you provide us is up to your discretion. We will endeavour to contact and send first hand photographs of the Watch, when we have any or one of the Watches that you have expressed that you desired, as part of the service in our stock. Subject to availability, you can opt to purchase and pay using one of our payment methods as set out in ‘Price and Payment’ in our ‘Terms and Conditions’. 

  • We will endeavour to contact when we have located and are able to acquire one of the Watch(es) that you expressed that you desired as part of the service, but do not yet have it in our stock. You can express your interest to opt to reserve to purchase. There is no definitive or set timeline as to when we will next be in contact. You can opt to pay using one of our payment methods as set out in ‘Price and Payment’ in our ‘Terms and Conditions’. 

  • If you do not respond to our attempt to contact you, we are under no obligation to hold or reserve any Watch(es) for you. 

 

FRAUDULENT PAYMENTS

  • If we reasonably suspect a fraudulent payment by debit or credit card, then we will not dispatch any Watch and we will not carry out any refunds until authorised by our bank.

ENTIRE AGREEMENT

WAIVER

  • If we fail, at any time during the term of a contract, to insist upon strict performance of any of your obligations under the contract or any of these Terms and, or if we fail to exercise any of the rights or remedies to which we are entitled under the contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.

  • A waiver by us of any default will not constitute a waiver of any subsequent default. No waiver by us of any of these Terms will be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

 

SEVERABILITY
